Lawsuit against Avante
The Florida Record reported that a nursing home in Florida has a new lawsuit against them filed by Linda A. Arrick, who serves as the Personal Representative of the Estate of Louise Giammarino. Arrick filed a lawsuit alleging severe neglect and mistreatment of an elderly resident, resulting in her death.
Louise Giammarino was a resident at Avante in Boca Raton. According to the complaint, Giammarino was severely neglected and abused at Avante. The staff failed to develop an adequate care plan and properly supervise Giammarino. She suffered infections, dehydration, falls, and unexplained injuries as a result of inadequate care.
Further, the complaint reveals that Avante at Boca Raton has several violation provisions under Chapter 400 of Florida Statutes. The violations include failure to provide appropriate healthcare and protective services, mental and physical abuse prevention measures, and compliance with health regulations. The complaint reads,
“As a direct result of Avante at Boca Raton’s acts and omissions, Louisa Giammarino suffered development and deterioration of infections and dehydration along with falls and unexplained injuries.”
The lawsuit accuses Avana at Boca Raton of inadequate staffing levels, improper training, and supervision of staff members, failure to maintain accurate medical records, lack of communication with family members about significant changes in health status, and other specific allegations. Arrick states that these failures result from the broader systemic issues within the facility, as stated above.
The plaintiff is seeking compensatory damages for the injuries, pain, and suffering that Louise Giammarino endured. They also ask for damages “related to loss of dignity; humiliation; mental anguish; inconvenience; loss of capacity to enjoy life; discomfort; aggravation of existing diseases or physical defects; medical expenses incurred due to negligence; and funeral expenses.”
