PREP Act

Two separate COVID-related wrongful death lawsuits against nursing home providers will determine if negligent providers gives immunity to nursing homes for abuse and neglect. Federal judges will decide the fate of thousands of neglected and abused victims. Justice delayed is justice denied.

The nursing home industry claims that the Public Readiness and Emergency Preparedness (PREP) Act provides absolute immunity for abuse and neglect by operators during COVID-19.  Negligent providers around the country facing wrongful death suits have also used the PREP Act as a defense to shield them against legal liability. They do not deserve blanket immunity.  A jury should decide these cases. A pnademic should not take away your constitutional right to a jury trial.

Meanwhile, total coronavirus infections are projected to peak in mid-October. Estimates include almost 400,000 cases nationwide. The lack of vaccinations especially among nursing home workers will cause the fourth wave.  As of mid-July, only 56% of Americans 12 and older are fully vaccinated. However, rates among nursing home workers are below that in the South. The COVID-19 Scenario Modeling Hub reported the United States is currently averaging about 62,000 new cases per day over the last week.

The Fourth Wave is coming. We can stop it with vaccinations. Please be safe.
