The Hill reported that Republican lawmakers in South Carolina may change the state’s criminal code. The new law would allow a person who receives an abortion to be eligible for the death penalty. What happened to being pro-life?
The bill called the South Carolina Prenatal Equal Protection Act of 2023 would define “person” to include a fertilized egg which will be protected under the state’s homicide laws including the death penalty. No exceptions for rape or incest.
So what if you smoke or drink while pregnant? What if someone injures a fetus in a collision? Can the fetus recover?
The bill provides an exception for a pregnant woman who underwent an abortion “because she was compelled to do so by the threat of imminent death or great bodily injury when all reasonable alternatives to save the life of the unborn child were attempted or none were available.”
Who decides what is imminent or reasonable?
