Poliakoff & Associates and Attorney Ken Connor presented a 3-week jury trial in a Nursing Home Neglect case in Oconee County, SC in September and October of 2014. The Plaintiffs maintained that Dorothy Reynolds was neglected by Seneca Health and Rehabilitation, resulting in pressure sores, infection and sepsis, malnutrition, weight loss and other neglect. All allegations were denied and the case was vigorously defended by the nursing home. While the jury was out, the Defendants increased their offer of settlement several times. Three hours into jury deliberations the Defendants made an offer that the Plaintiff wished to accept. Simultaneously, the Baliff announced that the jury had reached a verdict. The Plaintiff determined to accept the offer (a confidential amount). The offer was approved by the Judge. Thereafter, the Judge went to the jury room to thank them and dismiss them. The Jury Foreman had already signed the Verdict Form. They had awarded 29 million dollars – 4 million dollars actual damages plus 25 million in punitive damages.
